Definitions.

When we say “Selligion”, “we”, “ours”, or “us”, we mean Selligion Technologies Private Limited, and all its subsidiaries.

“Products” and “Services” are a reference to Selligion’s website, hardware, and service offerings made available to a customer.

And when we say “you”, “your”, or “user”, that means you as a potential or current user. If you’re engaging our services on behalf of a legal entity, you agree that you possess the authority to bind such an entity to these terms, and therefore “you” and “your” will refer to the entity as a whole.

The following “Agreement” is the set of terms and conditions that you are subject to when you use our website or access our products and services. We provide products and services that allow you to connect to our servers through the Internet and borrow computing ability for work, entertainment, e-commerce, and other uses. Our services may also include access to third-party software, features, and content that you can access directly through us or purchase from others.

Our products and services are owned and provided by Selligion Technologies Private Limited, headquartered at Unit-111, B wing, 119 Business Point, Sahar Road, Andheri (E), Mumbai – 400099, Maharashtra, India.

Our website (www.selligion.com) is an online store where you can purchase our Praho and our monthly subscription plans. We reserve the right to refuse service or refuse the sale of products at our sole discretion to anyone for any reason at any time.

By agreeing to these terms, you also agree that our products and services will be used only for lawful purposes without infringing the rights of any third party.

Updates and downtime.

We’re always working to improve our services with new features and capabilities. As part of these efforts, we may remove or change old features, or make changes to our subscription plans. We will attempt to precede such updates with warnings sent to your account.

Additionally, while we attempt to avoid disruptions, we extend no guarantee that there will be no outages, or that your content may be available during such outages. We are not liable for such outages or service changes.

Your Selligion account.

You will need a Selligion account in order to access our services on an ongoing basis. This will require a username and password of your choice, as well as contact information such as an email address, and billing information. You may also need to verify your account or add additional information to it in order to access certain features of our service.

Our Privacy Policy details what kind of information we collect and how we use it.

You are responsible for your account’s security, and you agree to notify us immediately in the event you believe it is compromised. If your account is compromised, we may not be able to restore access to you.

You are also responsible for updating the contact information related to your account. If you are locked out of your account, we may not be able to restore access without accurate contact information. We must also assume that any communications to us from your account or associated contact information have been intentional and legitimate.

Content and intellectual property.

Your content

Any content you add to our services by uploading remains your intellectual property. It is your responsibility to ensure that the content is lawful, that you have a right to upload it, and that you have the right to grant the licences defined here in the terms. We take no responsibility for your content and for others’ use of your content.

You agree to licence Selligion to use your content in the following ways:

To copy, distribute, share your content in ways consistent with how you use our services. This allows us to, for example, store and display any content you upload.

To modify and reformat your content. This may be required to resize your content for mobile displays for example.

To sublicense your content in order to continue providing our services. As an example, we need this in order to store your content with our cloud providers.

This licence is non-exclusive (you’re free to licence your content elsewhere), royalty-free (there are no fees to it), transferable, and perpetual (need not be renewed annually).

We also reserve the right to block, remove, and permanently delete your content for any reason, including a breach of our Terms of Service, our other policies, or applicable laws or regulations.

Our content

Our services may include some content that belongs to us. You’re entitled to use this content as enshrined in these terms, but we retain all intellectual property rights.

Other content

Our services may also allow you access to other content, whether belonging to other people or to third-party vendors. You may not use other people’s content without their consent, or as allowed by law. We are also not responsible for this content and cannot verify its accuracy or reliability.

Payments and subscriptions.

Upon purchasing one oof our products or registering for a paid subscription, you agree to pay us the specific monetary amount for that product or service, as described during the confirmation process. Failure to pay will result in your access to the product or device being revoked.

We may update the prices of our products and services in the future, at which time you will be informed of any changes to ongoing subscriptions in a timely manner.

We reserve the right to refuse service or the sale of products at our sole discretion, especially if these Terms of Service have been violated.

Acceptable use.

You agree not to use our products and services for unlawful purposes, or in a way that would infringe the rights of any third party, or in any way prohibited by these Terms of Service.

Do no harm to people: This includes trying to unlawfully gain access to another user’s account, infringing someone else’s intellectual property rights, harassing, bullying, defrauding other people, or using our services to commit a crime.

Do no harm to Selligion: This includes trying to crack into our systems, transmitting viruses or other malicious code through our services, defrauding us or our payment systems, and attempting to copy our product or use our intellectual property without permission.

Do no harm to society: This includes using our service to create unlawful gambling or pyramid schemes, engaging in illegal cryptocurrency mining, publishing defamatory information or information that incites violence, hate, or discrimination towards any group.

Your failure to uphold these basic tenets allows us the right to terminate your access to our services permanently.

Communication.

When you sign up for updates on our website or subscribe to our service, you consent to receive communications from us regarding updates to our services, payment reminders, and news of offers and events. You agree that this communication sent to you by us Website will not be construed as spam under any law

Using and ending our services.

You will need an Internet connection or a mobile data plan in order to use our services. You might also need additional equipment, like a headset, camera, mouse, and keyboard. You are responsible for providing all connections, and equipment (unless otherwise specified upon product purchase) as needed to use the services. The fees charged by your Internet service provider are in addition to any fees you pay for our services and we will not reimburse you for it.

You agree to pay in full for products or subscriptions you purchase from us. Our prices are subject to change, and will always be available on our website. In the event the prices for ongoing services you are accessing are to be updated, you will be notified about the changes in a timely manner through the contact details you provide at the time of registration.

We require valid information for the purchase of a product or service, including shipping and billing information. We reserve the right to reject or cancel an order if it includes errors or omissions of information. If we cancel an order after payment has been processed, we will issue you an equivalent refund amount within 5 to 7 days of receiving the refund request. Our property and security.

Indemnity.

We may allow access to third-party websites or services, but we are not liable for any loss or damage caused as a result of your use of these third-party services.

Changes to our terms.

Our Terms of Service may change from time to time. We have the right to modify any terms contained here, and these changes come into effect immediately upon posting to our website. We will attempt to notify you of any changes to our Terms of Service, but you agree that it is your responsibility to stay informed of any changes. Your continued access of our services after any modifications constitutes an agreement to the new Terms of Service.

Termination of services.

We may terminate these Terms of Service with you at any time, for any reason. We specifically reserve the right to terminate these terms if you violate our Terms of Service.

Entire agreement.

This agreement constitutes the entire licence agreement between both parties, including our Privacy Policy and other applicable policies.

Warranties.

The products and services are licenced “as is” and “as available”, subject to applicable law, and you bear sole risk for using them. Selligion gives no express warranties, guarantees, or conditions in relation to the products and services being offered.

Selligion refuses liability for any loss of data resulting from service outages, and is not responsible for inaccuracies or omissions in content available through the service.

We are also specifically not responsible or liable for any threatening, defamatory, obscene,

offensive or illegal content or conduct resulting from another party’s actions.

Limitation of liability.

Selligion is not liable for any damages that may occur as a result of your use of our products and services, except for where applicable by law. In those cases, we are only responsible to you for damages that are a reasonably foreseeable result of our reasonable failure to provide our services with the utmost care, or as a result of our breach of these Terms of Service. This doesn’t affect consumer rights that can’t be waived by a contract.

General provisions.

Language: All our communications and notices given related to these Terms of Service will be in English.

Jurisdiction and governing law: The laws of India will govern any matter or dispute relating to these Terms of Service, or arising out of dispute between you and Selligion. In case of litigation, both parties agree to submit to the exclusive jurisdiction of the courts at Mumbai, India. By agreeing to these terms, you waive the right to object to the venue.

Severability: If any part of these Terms of Service is held invalid or unenforceable by a court of law, the remainder will continue in full force and be enforced to the maximum extent possible.

Enforcement: Failure to enforce any provision of our Terms of Service is not to be considered a waiver of any future enforcement of that or other provisions.
